Montwells is a real estate broker registered in Montenegro under the Law on Brokerage in Real Estate Sale and Lease (Zakon o posredovanju u prometu i zakupu nepokretnosti, Official Gazette of Montenegro 89/25, as amended) and holds professional liability insurance as that law requires.

Property details, prices, availability, renders, floor areas and delivery dates are published in good faith from information supplied by owners and developers and are updated regularly, but they are an invitation to enquire, not an offer, and do not form part of any contract. Areas are approximate; prices may change without notice and, unless stated otherwise, are shown in euros including 21 % VAT where VAT applies; off-plan images are conceptual and developers may alter plans and specifications. Before any purchase, rely only on the documents verified during due diligence (cadastre extract, permits, use permit) and on the contract signed before a notary public. Nothing on this site is legal, tax or investment advice; we recommend independent legal advice for every transaction.

These general terms form part of every brokerage contract we conclude and are displayed here and at our office as the Law on Brokerage requires.

Services. Under a brokerage contract Montwells will: search for and introduce properties or buyers/tenants; check the property's ownership and permit documents and warn the client of any deficiencies; market the property and arrange viewings; mediate negotiations and assist with the preparation of the pre-contract and contract and the notarial signing; and, where separately and expressly authorised in writing, perform other acts for the client.

Fee. Our brokerage fee is 3 % of the agreed purchase price (or one month's rent for a lease); no VAT is added, payable by the party that engaged us, unless the brokerage contract states otherwise. The fee is earned when the contract we brokered is concluded, and is payable on signing of the pre-contract or, where there is none, of the main contract. Under the Law on Brokerage the fee also falls due if, within 24 months after the brokerage contract ends, the client concludes a transaction with a party introduced through our work.

Additional services and costs. Services beyond brokerage — translations, certified valuations, legal representation, residence-permit assistance, property management — are provided only on request and charged at the rates agreed in writing in advance; official fees (notary, cadastre, translation, court fees) are paid by the client directly.

Client funds. Any deposit entrusted to us is held on a separate client account, as the law requires, and is not used for our operations.

Identification. Before concluding a transaction we must identify every client under Montenegro's anti-money-laundering law and may decline a transaction where identification or source of funds cannot be established.

We take reasonable care to keep the site accurate and available but do not guarantee uninterrupted access and are not liable for loss arising from reliance on listing information that has not been verified in a transaction. Enquiries submitted through the site are handled under our Privacy policy. Consumers have the rights granted by the Law on Consumer Protection of Montenegro, which these terms do not limit. These terms are governed by the laws of Montenegro; disputes are subject to the courts of Montenegro, with the court in Kotor having jurisdiction for business clients. If you are a consumer, you may also submit a complaint to us in writing and we will reply within 15 days.
